This week is Resolution’s Good Divorce Week – a national initiative that shines a light on a “better way” to separate. At a time when family courts are under immense strain, Good Divorce Week encourages couples to explore constructive, non-confrontational solutions that prioritise cooperation, communication, and the wellbeing of children.
Every working day, over 1,000 new cases begin in the family courts. The result is increased delays, limited resources, and families left in limbo at what is already one of the most challenging times in their lives. But the truth is, not every family needs to go to court. There are often other ways to resolve matters that are more affordable, less stressful, and far less damaging – particularly where children are involved.
What is Good Divorce Week?
Good Divorce Week is led by Resolution, a community of over 6,500 family justice professionals committed to promoting a constructive approach to family breakdown. Members – including the family law specialists at Hutchinson Thomas – work to help separating couples find fair, balanced solutions without unnecessary conflict.
The initiative is built around Resolution’s Code of Practice, which sets out a professional and compassionate framework for how members support their clients. It’s not just a set of ideals – it’s a practical guide for everyday practice that puts families first.
At its heart, the Code encourages:
- Avoiding inflammatory language
- Supporting families to put the best interests of children first
- Acting with honesty, integrity and objectivity
- Helping clients consider the long-term emotional and financial impact of their decisions
- Promoting communication and collaboration wherever possible
- Using professional experience to guide clients through their options clearly and calmly
Why court isn’t always the best option
While some disputes will inevitably require a court’s intervention, litigation should always be the last resort. Court proceedings can often intensify conflict, take many months to conclude, and create long-term emotional and financial strain.
Alternatives such as mediation, collaborative law, or arbitration allow couples to retain control over their decisions, move forward more quickly, and build a foundation for better communication in the future. These methods also help shield children from conflict – something that lies at the heart of the Good Divorce Week message.
The role of early legal advice
Good Divorce Week also highlights the importance of seeking early legal advice. Understanding your rights, responsibilities, and options at the outset can prevent misunderstandings and help avoid unnecessary disputes later on.
