Hutchinson Thomas / For individuals / Wills, trusts & probate
We regularly advise clients on:
• Wills and tax planning
• Estate administration and Deeds of Variation
• Trusts and asset protection
• Powers of Attorney
• Court of Protection and Deputyship applications
• Long-term care and funding issues
• Disputes involving Wills and estates
We understand that every family and every situation is different. Our team will take the time to listen, explain your options clearly, and help you make informed decisions with confidence.
Making a Will gives you peace of mind and ensures your wishes are respected. We prepare Wills for all types of family circumstances and can advise on inheritance tax planning to protect your estate for future generations.
If you already have a Will, we can review it with you to ensure it still reflects your current wishes and circumstances.
Dealing with a loved one’s estate can be overwhelming. We offer a sensitive but efficient service—whether you want us to handle everything or just assist with the more technical aspects.
We also advise on Deeds of Variation, which can be used to alter the distribution of an estate after death, often for tax or family reasons.
Trusts can be used to protect assets, reduce tax liability, or provide for loved ones in a controlled way. We have extensive experience in setting up and managing trusts for a wide range of purposes, including preserving the family home or supporting vulnerable beneficiaries.
A Lasting Power of Attorney (LPA) allows someone you trust to make decisions on your behalf if you become unable to do so. We can help you put LPAs in place for both financial and health matters—and our partners are also happy to act as attorneys where appropriate.
If someone loses mental capacity and hasn’t made an LPA, we can apply to the Court of Protection for a Deputyship Order. We also specialise in Statutory Wills and applications for gifts or tax planning on behalf of someone who lacks capacity.
These applications can be complex and sometimes contentious. We have a strong track record of success in this area.
We advise on long-term care planning and have helped clients recover significant sums from Local Health Boards through Continuing Healthcare Funding claims.
When disagreements arise, our Contentious Probate Team is here to help. We handle disputes with sensitivity and determination—always aiming to resolve matters efficiently and fairly.
