We can also offer you advice in the early stages of an employment dispute and we may be able to settle the matter and obtain compensation on your behalf without the need to attend an employment tribunal. If your employer is willing to settle the matter, we will negotiate a settlement agreement and advise you on the implications of signing it.
We will advise you in respect of the grievance procedure and the Acas early conciliation process which must generally take place before you apply to an employment tribunal. If it is not possible to reach an agreement, we will represent you robustly during employment tribunal proceedings.
Making an employment tribunal claim
There are deadlines to meet if you intend making a claim at an employment tribunal, so you should ensure that you do not delay if you believe you have a valid claim.
We will work with you to put together an accurate account of your complaint together with supporting documentation and send this to the employment tribunal within the required time frame.
Once your employer has replied we will go through their response with you and prepare for the hearing. We will speak on your behalf at the tribunal hearing and ensure that you have been thoroughly prepared. There could be a last-minute attempt to settle by your employer, and we will advise you on whether they have made a good offer and what your options are.
If you win, your employer may also make you an offer before the tribunal imposes one. There could be advantages to taking this, as it may include benefits other than just a payment, such as their agreement to provide you with a reference to give to your next employer.
Employment appeal tribunal
After the hearing, we will go through the decision with you. In the event that either you or your employer are not satisfied with the result, an appeal could be made to the employment appeal tribunal, although this is not a frequent occurrence. If this happens, we will advise you of the implications and represent you in any further action.
